MGA invites stakeholders to participate in AMLA public consultations on draft Regulatory Technical Standards

The Malta Gaming Authority wishes to inform all authorised persons and relevant stakeholders of the open public consultations launched by the new EU Anti-Money Laundering Authority (‘AMLA’) on three draft Regulatory Technical Standards (‘RTS’).

These consultations cover:

  • the Draft RTS issued under Article 28(1) of the Anti-Money Laundering Regulation (Regulation (EU) 2024/1624) (‘AMLR’ or the ‘Regulation’) concerning customer due diligence;
  • the Draft RTS under Article 19(9) of the same Regulation regarding the criteria for identifying business relationships, occasional and linked transactions and the determination of lower thresholds; and
  • the Draft RTS issued under Article 53(10) of the Anti-Money Laundering Directive (Directive (EU) 2024/1640) (‘AMLD6’) in relation to reporting material weaknesses.

These consultations represent an important legislative stage for the gaming sector, particularly because AMLA is now consulting on the non-financial sector, which includes the gaming sector. In view of the ongoing transition to a more unified and risk-sensitive EU legislation, this consultation phase offers licensees a valuable opportunity to familiarise themselves with the proposed measures and to contribute feedback that reflects operational realities within both the online and the land-based gambling sector.

Early and meaningful engagement is essential, as well-informed input can help ensure that the resulting technical standards remain proportionate, well-calibrated, and responsive to sector-specific risks. Licensees are therefore strongly encouraged to participate actively in the consultation process by submitting feedback directly to AMLA through its designated channels.

AMLA has set two deadlines for the submission of consultation responses:

  • Monday, 9 March 2026 for feedback on the Draft RTS under Article 53(10) of AMLD6; and
  • Friday, 8 May 2026 for feedback on the Draft RTS under Articles 28(1) and 19(9) of the AMLR.

The Authority encourages all relevant stakeholders to review these developments carefully and to contribute to the consultation process in whatever manner they consider most appropriate. As part of its ongoing commitment to supporting the industry during the implementation of the EU AML Package, the Authority highlights that active and meaningful engagement from stakeholders is essential to ensuring that the evolving framework remains effective, proportionate, and grounded in the operational realities of the gaming sector.

Should any authorised person wish to raise sector-specific concerns or discuss aspects of the draft RTS in greater detail, the Authority is available for this purpose. Participants are also invited to share any written feedback directly with the Authority, which will further inform the Authority’s ongoing engagement on these matters.
